摩天31社區為了遏止委員會把持社區資源,只公告及傳播有利於己方的言論,所以早就由住戶於智邦社區申請成立了社區網站,避免一言堂的發生!近年又隨著時代的演進,由熱心人事發起成立了FB社群及line的群組來分享社區訊息!上屆幾位少數委員於未經管委會合於規約程序做出決議下,就擅自與廠商簽訂高達數百萬的合約,因而被住戶自費提出告訴,並於後續區大被大多數住戶認為應對其究責,故通過提案應追究其責任以維護公共利益!也就是通過提案授權本屆管委會可動用管理費來追究上屆委員的所做所為!惟承辦檢察官心證認為上屆幾位委員等被告,雖有未依社區規約所規定之決議方式進行決議之情,但應屬處理事務之過失問題,惟尚不足以構成背信罪之成立要件。(亦即雖有違反規約決議方式之事實,但尚無法依此即認定被告等有意圖不法利益而為以上簽約之行為),所以最後做出不起訴處分!而上屆這些委員於做出這樣違反規約的簽約行為時,早經其它委員及住戶提出抗議,但當時的抗議就像底下C Wang所提到的,被他們"禁止其它委員或住戶表答反對意見"!結果現在當初禁止其它人表達對他們意見的人,跳出來說別人禁止他們表達意見了!本社區這些爭議誰是誰非,其實早在本社區108年底的區大,由區權人很明顯的做出評斷了。那就是高票通過了提案"『對於未依社區規約所規定之決議方式進行決議,即與廠商簽約或動用社區基金進行修繕之委員,進行法律責任究責及追償所造成之社區損失,以維護公共利益。』
