疫情之前調節委員會傳喚商家兩次,商家都沒出席…. 各位親愛的美女們,在網路購物時,別忘了保障自己的消費權益,消保法如下 第 19 條 通訊交易或訪問交易之消費者,得於收受商品或接受服務後七日內,以退回商品或書面通知方式解除契約,無須說明理由及負擔任何費用或對價。我僅針對消費者自身權益提出退費,店家卻再三表示將委任律師提告本人。 這是一家說是正韓貨,但是我訂購三次,每一次都有一件是瑕疵商品,第一件是整隻袖子都是黑點,可退錢,第二次是袖子破一個大洞,當時過年退貨條件是三天內,所以就自己縫了,這ㄧ次是有三個黑點,分別在不同地方,去電說是小瑕疵不能退,說必需破大洞,整片髒污才算,衣服就算穿了十年,也不會如此糟糕吧? 店家的處理,首先小幫手堅持非大瑕疵則無法退貨,店長來電執意要我回收評論,違反個人之言論自由,此外,還再三強調要保留法律追訴權,但是我的確有購物行為,我也沒有到處抹黑。我只在google提出我的購物經驗與諮詢,並建議店家可以回覆聲明並提出證明是正韓,但店家沒有,幾年前我有去實體店面,店長有解釋有正韓貨較貴跟大陸製較便宜的差別,我覺得這樣解釋對消費者來說很好,但目前店家在網路拍賣都說是正韓。 店長來電的說詞反覆,起初表示將提供跟韓國廠商的對話給我,但我沒收到,又說店家無現貨,先提供的圖片我看不出來也有污點,之後又再提供一張有污點的照片,可信度?? 昨日店家在臉書的聲明及來電說本人到處抹黑店家,我可以不追究,但是依消基法消費者是可以在七日內無需任何理由要求退款,我依消基法辦理全部貨品退款共計3185元,已聯繫店家敬請協助後續處理,但是店家仍堅持委任律師提告本人,這真的是本人第一次遇到如此優質的商家,過去留錯言加一,立即提出取消,也被遭拒絕,也只能花錢買自己不喜歡的衣服,不過店裏到的衣服都很香,想到洗完後香味仍然殘留.... 我們僅是市井小民,沒有店家強大的律師資源,也只能透過消基會的申訴管道1950,來申請消費者的網路購物權益,目前已至消基會進行相關申訴,敬請店家近日留意消保官的調查電話,只希望能獲得一個公平合理的消費申訴調查結果。 關於貨品出示相關文件資料及維護消費者權益的消保法如下,提供給聰明的美女了解一下,增長知識。 第 25 條 企業經營者對消費者保證商品或服務之品質時,應主動出具書面保證書。 前項保證書應載明下列事項: 一、商品或服務之名稱、種類、數量,其有製造號碼或批號者,其製造號 碼或批號。 二、保證之內容。 三、保證期間及其起算方法。 四、製造商之名稱、地址。 五、由經銷商售出者,經銷商之名稱、地址。 六、交易日期。 第 56 條 違反第二十四條、第二十五條或第二十六條規定之一者,經主管機關通知改正而逾期不改正者,處新臺幣二萬元以上二十萬元以下罰鍰。 第 17 條 中央主管機關為預防消費糾紛,保護消費者權益,促進定型化契約之公平化,得選擇特定行業,擬訂其定型化契約應記載或不得記載事項,報請行政院核定後公告之。 前項應記載事項,依契約之性質及目的,其內容得包括: 一、契約之重要權利義務事項。 二、違反契約之法律效果。 三、預付型交易之履約擔保。 四、契約之解除權、終止權及其法律效果。 五、其他與契約履行有關之事項。 第一項不得記載事項,依契約之性質及目的,其內容得包括: 一、企業經營者保留契約內容或期限之變更權或解釋權。 二、限制或免除企業經營者之義務或責任。 三、限制或剝奪消費者行使權利,加重消費者之義務或責任。 四、其他對消費者顯失公平事項。 違反第一項公告之定型化契約,其定型化契約條款無效。該定型化契約之效力,依前條規定定之。 中央主管機關公告應記載之事項,雖未記載於定型化契約,仍構成契約之內容。 企業經營者使用定型化契約者,主管機關得隨時派員查核。 第 56-1 條 企業經營者使用定型化契約,違反中央主管機關依第十七條第一項公告之應記載或不得記載事項者,除法律另有處罰規定外,經主管機關令其限期改正而屆期不改正者,處新臺幣三萬元以上三十萬元以下罰鍰;經再次令其限期改正而屆期不改正者,處新臺幣五萬元以上五十萬元以下罰鍰,並得按次處罰。
