唯一遺憾的是最高法院沒有審理案件，只能廢棄原判決，發回原審法院更審。然而案件發回原審法院，最高法院卻無權監督原審法院如何更審，更審法官在不能違背同事的裁定太多之下，會如何更審？
一審“地方法院” 。二審還是“地方法院” 。三審“ 最高法院”。 更審“依然地方法院”。
然而一審，二審，更審又是同那幾名法官在審。
一審暫時處分案比本案更有效力之裁定書，卻將他人的案子，名字（完全陌生的名字）寫在裁定書上，而二審依樣畫葫蘆拷貝貼上於裁定書上，簡直將司法當兒戲。
如此審理程序下如何做到公平正義。
地方法院法官在無監督機制的裁定書，自由心證凌駕中華民國的律法，如此不公不義的司法，叫當事人如何信服？
司法院長許宗力先生，要求地方法院院長抽閱法官的裁定書，地方法院法官拿著“審判獨立“這支令牌，極力反彈，希望司法院長堅持司法改革，還給人民一個公道。
