瓦斯業者應交付鋼瓶押金收據 並不得向消費者收取鋼瓶檢驗費 日期:107-01-19 資料來源:消費者保護處 行政院核定內政部及經濟部擬訂之「家用液化石油氣供氣定型化契約應記載及不得記載事項」,規範瓦斯業者如有收取容器保證金(鋼瓶押金),應同時提供消費者收據;容器檢驗費由瓦斯業者負擔,不得向消費者加收檢驗費;瓦斯業者回收之容器內如有殘餘氣量時,應按比例退還消費者氣價,提供消費者更完善之保障。 國內目前使用桶裝瓦斯的用戶約506萬戶,瓦斯零售業者約2,856家。行政院消保處統計106年桶裝瓦斯申訴案件約150件,主要糾紛類型為業者未全額退還瓦斯鋼瓶押金,以及因鋼瓶屆滿檢驗期限而向消費者加收檢驗費。為使瓦斯業者與消費者雙方之權利義務更加明確,行政院核定內政部及經濟部擬訂之「家用液化石油氣供氣定型化契約應記載及不得記載事項」, 規範之重要內容如下: 一、安全事項:近來發生瓦斯氣爆事件時有所聞,應記載事項規範瓦斯業者應於每次更換容器後檢查其管線是否有安裝完善,有無洩漏情形;另瓦斯業者應由安全技術人員對消費者處所之供氣設備,每二年提供一次安全檢測服務。§4 二、計價方式:除傳統之桶裝瓦斯以公斤為單位之重量計價方式外,未來隨著產業之發展,將有加裝氣量計以度為單位之氣量計價方式,消費者與瓦斯業者得約定擇一辦理。§2 三、額外收費:瓦斯業者因消費者之個別狀況有額外收費之情形時(例如需人力搬運至高樓層或消費者居住偏遠等因素),應事先約定清楚,並於提供液化石油氣前明確告知。§5 四、容器檢驗費:容器之購置、檢驗及相關維修等費用由瓦斯業者負擔,瓦斯業者不得藉故向消費者加收檢驗費。§7、§9 五、容器保證金:鑑於瓦斯業者於首次送瓦斯時向消費者收取容器保證金,而於消費者不再使用時拒絕退還或僅退還部分保證金之糾紛類型,應記載事項規範業者如有收取保證金時,應同時提供消費者收據,消費者不再使用液化石油氣時,應將容器歸還瓦斯業者,瓦斯業者應將保證金全數退還給消費者。§6、§13 六、容器使用費:鑑於消費者將容器長久置放家中卻不常使用,衍生瓦斯業者增加經營成本,遂將檢驗費轉嫁給消費者,致消費糾紛頻傳,為衡平契約雙方當事人之權益,應記載事項明訂消費者購買液化石油氣使用同一容器逾1年返還者,瓦斯業者得向消費者收取容器使用費,但不得逾200元,逾2年返還者不得逾400元。§9 七、殘氣退費機制: 採重量計價者,瓦斯業者回收容器時,應量秤容器內殘餘液化石油氣量,並以回收容器當日之交易價格,按比例退還消費者未使用之氣價。§10 行政院消保處表示:企業經營者使用定型化契約,違反公告事項,經主管機關令其限期改正而不改正者,最高可處新臺幣五十萬元罰鍰。企業經營者應遵守相關規範,避免衍生消費爭議。
