★ ★ ★ ★ ★ 去年2020年買了璟都建設在桃園中路的預售屋,今年六月使用執照下來陸續交屋至今。在初次驗屋前,建商/代銷完全不讓買方進入內看情況,說是工地施工怕危險,我也不疑有他。
果然驗屋就有很多驚喜,發現許多項目完全與合約不符:
第一,全棟冷水管的合約材質記載不鏽鋼壓接,但驗屋後發現各戶是用成本較低廉的PVC材質。且還將頂樓的PVC水管材刻意用水泥全部封死,掩人耳目。(若以保護管線為由,為方便後續維護,應以活動式白鐵蓋保護,並非以水泥封死)
第二,合約記載瓦斯主幹管設置於各戶外牆,但現場看到主幹管設置在陽台內。且陽台內各式污水幹管恣意混亂貫穿、作工粗糙、毫無章法。(有上下戶漏水疑慮)致使空調室外機、洗衣機、熱水器擺放困難(大幅降低使用坪效及採光通風,並有逃生疑慮)
第三,合約平面格局圖,在廚房畫有冰箱擺放空間,但實際施工卻誤做流理台尺寸,使得廚房完全沒有剩餘空間可擺冰箱。(部分戶型,20幾戶)
還有客餐廳樑柱未預留冷氣管線的穿樑套管(合約也有載明)。
未交屋就發生頂樓戶漏水, 地下室連續壁漏水這些常見的問題當然也有。
更有未交屋的鄰居發現,家中的戶與戶之間的RC結構牆,有大面積的水泥塊崩落,如此施工品質強烈造成住家安全疑慮。
以上違約項目住戶們反映後,建商一開始完全不處理,直到住戶幾十戶聯合到消保會申訴,歷經數月的消保協調。
最近建商才提出一個可笑的低額補償金(1萬5),並且建商的和解書還提到必須放棄其他瑕疵請求權,很多住戶都不敢簽。
結論就是各位買預售屋要小心。 否則可能贈送消保知識以及消費糾紛的法律知識課程。
這個建商目前在推的建案叫做璟都米蘭,各位購屋者要當心注意。
Last year, in 2020, I bought a pre-sale house in Jingdu Construction on Taoyuan Middle Road. In June of this year, I used the license to hand over the house one after another. Before the initial home inspection, the builder/consignment agency completely prevented the buyer from entering the premises to see the situation, saying that the construction site was afraid of danger, and I did not suspect him.
Sure enough, there were many surprises in the home inspection, and many projects were found to be completely inconsistent with the contract:
First, the contract material of the cold water pipes of the whole building records stainless steel crimping, but after the house inspection, it was found that each household was using the cheaper PVC material. In addition, the PVC water pipes on the top floor were deliberately sealed with cement to conceal people's eyes. (If the protection of the pipeline is used as an excuse, in order to facilitate subsequent maintenance, it should be protected with a movable white iron cover, not sealed with cement)
Second, the contract records that the gas main pipe is installed on each outdoor wall, but the main gas pipe is seen on the spot to be installed in the balcony. In addition, all kinds of sewage main pipes in the balcony run through chaotically, rough work, and disorderly. (There are concerns about water leakage in the upper and lower households), which makes it difficult to place the outdoor units of air conditioners, washing machines, and water heaters (significantly reducing the use of floor efficiency and lighting and ventilation, and there are doubts about escape)
Third, the contract floor plan shows that there is a refrigerator storage space in the kitchen, but the actual construction mistakes the size of the countertop, so there is no space left in the kitchen for the refrigerator. (Some apartment types, more than 20 households)
There are also beam-through casings where the air-conditioning pipeline is not reserved for the beams and columns of the guest restaurant (the contract is also specified).
Of course, there are common problems such as water leakage from the top floor tenants before the house is handed over, and water leakage from the continuous wall of the basement.
Even neighbors who have not handed over the house found that a large area of cement block collapsed on the RC structural wall between the households in the house. This construction quality strongly caused household safety concerns.
After the residents of the above breached projects reported, the builders did not deal with it at all at first, until dozens of households joined the Consumer Insurance Association to appeal, after several months of consumer insurance coordination.
The builder only recently proposed a ridiculously low compensation (15,000), and the builder’s settlement also mentioned that it must give up other claims for defects, and many residents were afraid to sign it.
The conclusion is that everyone should be careful when buying pre-sale homes. Otherwise, it may give away consumer protection knowledge and legal knowledge courses on consumer disputes.
The construction project that this builder is currently pushing is called Jingdu Milan, home buyers should be careful.
