我希望店家可以瞭解一下相關網路購物之法規,這次事情我也不想搞的這麼麻煩,我也不想在複雜化,就由我自行吸收,我也不退換貨了,網路購物無瑕疵不給退貨退費,要這樣做請先在網路註明,而店家在出貨單上面才註明有瑕疵才給退貨不是明智之舉⋯⋯能否在銷貨之前就告知,我就不會搞這齣,而我本來開心要送禮用,現在也只好在去別處另買了,等於這產品對我毫無用武之地直接虧損,我寧可退貨後運費部分由我自行吸收,但經思考已經老店家老老闆了,應該要耗費很多時間跟店家交流討論現代法規,而我最近很忙沒時間處理這事,只好經由網路留言告知店家,不好意思在麻煩店家詳細瞭解相關之規定⋯⋯ 行政院消保會表示,多數消費者在詢問退貨問題,都誤認消費 者購物後,都有七日退貨保障規定適用,然而依據消保法第 19 條第 1 項規定,只限於「郵購買賣」或「訪問買賣」之消費者,才能享有 購物後,不用說明理由及負擔任何費用或價款,對於所買受的商品, 如果有不想購買,在收到商品後七日內,以退回商品或以書面通知企 業經營者方式,達到解約退款目的。 換言之,消保法規定消費者可以七日內無條件退貨的交易方 式,僅限於「郵購買賣」和「訪問買賣」二種交易型態。所謂「郵購 買賣」,依據消保法第 2 條第 10 款規定,僅限於企業經營者是以廣 播、電視、電話、傳真、型錄、報紙、雜誌、網際網路、傳單或其他 類似之方法,讓消費者未能檢視商品而與企業經營者所成立之買賣。 另外所謂「訪問買賣」,係指企業經營者未經邀約而在消費者之住居 所或其他場所從事銷售,所成立之買賣。故一般到賣場或實體商店購 物,消費者都沒有消保法有關七日內無條件退貨的權利。 行政院消保會提醒消費者,購物前應三思,不要受到業者促銷 利誘而倉促購物,另外在一般賣場及實體商店購物,消費者並沒有消保法第 19 條第 1 項規定,可以無條件在七日內退貨權利,消費者如 因而發生消費糾紛,可撥打 1950 消費者服務專線,向各地方政府消 費者服務中心申訴,或至 1950.gov.tw 網站線上申訴,以保障自身權 益。 ※轉載自行政院消費者保護委員會
